Welcome to Product Forge. These Terms and Conditions (“Terms”) govern your use of our website, app, and related services (the “Services”). By installing or using our Services, you agree to these Terms. If you do not agree, you must not use the Services.

1. Eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms to use our Services. If you install the app on a Shopify store, you represent that you are the store owner or authorized to act on behalf of the store owner.

2. Use of Services

• You may use Product Forge only for lawful purposes and in accordance with Shopify’s Terms of Service.
• You agree not to misuse or attempt to disrupt the Services.
• We grant you a limited, non-exclusive, non-transferable license to use the Services for your Shopify store during your subscription.

3. Shopify Integration

Product Forge is a Shopify embedded app. By installing the app, you authorize us to access certain data from your Shopify store as necessary to provide the Services, including product, order, and limited customer information. We do not use this data outside the scope of the app’s intended functionality.

4. Subscriptions and Payments

• Fees are billed through Shopify’s billing system and are subject to their payment terms.
• Subscriptions automatically renew unless cancelled via your Shopify admin.
• No refunds are offered except as required by law.

5. Intellectual Property

All content, software, and technology underlying the Services are owned by or licensed to Product Forge. You may not copy, modify, distribute, or reverse engineer any part of the Services except as expressly permitted by law.

6. Uploaded Content

Merchants may enable customers to upload images or other content via Product Forge. You are solely responsible for ensuring such content complies with applicable laws and does not infringe third-party rights. We are not liable for content uploaded by you or your customers.

7. Termination

We may suspend or terminate your access to the Services if you violate these Terms, misuse the Services, or as otherwise reasonably necessary. You may uninstall the app at any time through Shopify, which will terminate your subscription.

8. Disclaimer of Warranties

The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, Product Forge and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages, or loss of profits, revenue, data, or business opportunities, arising from or related to your use of the Services.

10. Indemnification

You agree to indemnify and hold harmless Product Forge, its officers, employees, and partners from any claims, damages, or expenses arising from your use of the Services, your violation of these Terms, or your violation of any rights of another.

11. Changes to Terms

We may update these Terms from time to time. Changes will be effective when posted on our website or in the app. Continued use of the Services after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of England, without regard to conflict of laws principles. Disputes shall be subject to the exclusive jurisdiction of the courts of that region.
